This Privacy Policy explains how we collect, use, disclose, and process your personal data when you use our website and other places where Lekt Software OÜ may act as a data controller and link to this Privacy Policy—for example, when you interact with lekt.ai or other products as a consumer for personal use ("Services").

This Privacy Policy also describes your privacy rights. More information about your rights, and how to exercise them, is set out in the “Your rights” section.
1. Collection of Personal Data

We collect the following categories of personal data:
1.1. Personal data you provide to us directly
1.1.1. Identity and Contact Data: We collect identifiers, such as your name, email address, and phone number when you sign up for an Lekt AI account, or to receive information on our Services. We may also collect or generate indirect identifiers, e.g. your nickname.
1.1.2. Payment Information: We may collect your payment information if you choose to purchase access to our products and services.
1.1.3. Inputs and Outputs: The AI models we provide allow you to prompt the Services in a variety of media including but not limited to the format of text, files and documents, voice input, photos and images, and other materials along with the metadata and other information contained therein (“Prompts” or "Inputs"), which generate responses (“Outputs” or “Completions”) based on your Inputs. If you include personal data in your Inputs, we will collect that information and this information may be reproduced in your Outputs. Templates, AI assistants and other features that require your input are also treated as Inputs.
1.1.4. Feedback on your use of our Services: We appreciate feedback, including ideas and suggestions for improvement or rating an Output in response to an Input ("Feedback"). If you rate an Output in response to an Input—for example, by using the thumbs up/thumbs down icon—we will store the related conversation as part of your Feedback.
1.1.5. Communication Information: If you communicate with us, including via our social media accounts, we collect your name, contact information, and the contents of any messages you send.

1.2. Personal data we receive automatically from your use of the Services

1.2.1. Device and Connection Information. In accordance with the permissions granted by your device or browser, your device or browser autonomously transmits details to us regarding the timing and manner of installation, access, or utilization of our Services. This encompasses data such as your device model, details of the operating system, browser specifics, and web page referral information, mobile network details, connection particulars, mobile operator or internet service provider (ISP), time zone configuration, IP address (inclusive of location information inferred from your IP address), and identifiers (including device or advertising identifiers, probabilistic identifiers, and other distinctive personal or online identifiers).
1.2.2. Usage Information. We collect information about your use of the Services, such as the dates and times of access, browsing history, search, information about the links you click, pages you view, and other information about how you use the Services, and technology on the devices you use to access the Services.
1.2.3. Log and Troubleshooting Information. We collect information about how our Services are performing when you use them. This information includes log files. If you or your device experiences an error, we may collect information about the error, the time the error occurred, the feature being used, the state of the application when the error occurred, and any communications or content provided at the time the error occurred.
1.2.4. Cookies & Similar Technologies. We and our service providers use cookies, scripts, or similar technologies (“Cookies”) to manage the Services and to collect information about you and your use of the Services. These technologies help us to recognize you, customize or personalize your experience, market additional products or services to you, and analyze the use of our Services to make them safer and more useful to you. 2. How we use Personal Data

2.1. We may use Personal Data for the following purposes:
  • 2.1.1. To provide and maintain our Services;
  • 2.1.2. To improve and develop our Services and new features and conduct research;
  • 2.1.3. To communicate with you, including to send you information or marketing about our Services and events;
  • 2.1.4. To prevent fraud, criminal activity, or misuses of our Services, and to protect the security of our systems and Services; and
  • 2.1.5. To comply with legal obligations and to protect the rights, privacy, safety, or property of our users, us, our affiliates, or any third party.
2.2. Your Inputs or Outputs will not be used for AI model training by Lekt Software OÜ.
3. Disclosure of Personal Data

In certain circumstances we may disclose your Personal Data to:
3.1. Vendors and Service Providers: To support our business operations and fulfill specific services and functions, we might share Personal Data with vendors and service providers. These include, but are not limited to, hosting service providers, customer service vendors, cloud service providers, content delivery networks, data warehousing services, support and safety monitoring services, email communication platforms, web analytics services, payment processors, transaction facilitators, and other information technology service providers. These parties will access, process, or store Personal Data solely based on our directions and strictly for the purpose of performing their roles for us.
3.2. Business Transfers: In the event that we participate in strategic transactions, reorganization, bankruptcy, receivership, or a service transition to a different provider (collectively referred to as a “Transaction”), your Personal Information and other relevant data may be revealed during the due diligence process to counterparties and other parties aiding in the Transaction. Furthermore, this data may be transferred to a successor entity or affiliate as part of the Transaction, along with other assets.
3.3. Government Authorities or Other Third Parties: We may share your Personal Data, including information about your interaction with our Services, with government authorities, industry peers, or other third parties in compliance with the law (i) if required to do so by law or in the good faith belief that such action is necessary to comply with a legal obligation, (ii) to protect and defend our rights or property, (iii) if we determine, in our sole discretion, that there is a violation of our terms, policies, or the law; (iv) to detect or prevent fraud or other illegal activity; (v) to protect the safety, security, and integrity of our products, employees, or users, or the public, or (vi) to protect against legal liability.
3.4. Other Users and Third Parties You Share Information With: Certain features allow you to display or share information with other users. For example, you may share Lekt AI conversations with other users via shared links.
4. Retention

4.1. We’ll retain your Personal Data for only as long as we need in order to provide our Service to you, or for other legitimate business purposes such as resolving disputes, safety and security reasons, or complying with our legal obligations. How long we retain Personal Data will depend on a number of factors, such as:
  • 4.1.1. Our purpose for processing the data (such as whether we need to retain the data 4.1.2. to provide our Services);
  • 4.1.3. The amount, nature, and sensitivity of the data;
  • 4.1.4. The potential risk of harm from unauthorized use or disclosure of the data;
  • 4.1.5. Any legal requirements that we are subject to.
4.2. In some cases, the length of time we retain data depends on your settings or actions. For example, deleted conversation texts are deleted permanently within 30 days, but other metadata (e.g. word count used, message sending date, etc) is still stored indefinitely.

5. Your rights

5.1. You have the following statutory rights in relation to your Personal Data:
  • 5.1.1. Access your Personal Data and information relating to how it is processed.
  • 5.1.2. Delete your Personal Data from our records.
  • 5.1.3. Rectify or update your Personal Data.
  • 5.1.4. Transfer your Personal Data to a third party (right to data portability).
  • 5.1.5. Restrict how we process your Personal Data.
  • 5.1.6. Withdraw your consent—where we rely on consent as the legal basis for processing at any time.
  • 5.1.7. Lodge a complaint with your local data protection authority (see below).
5.2. You have the following rights to object:
  • 5.2.1. Object to our processing of your Personal Data for direct marketing at any time.
  • 5.2.2. Object to how we process your Personal Data when our processing is based on our legitimate interests.
5.3. You can exercise some of these rights through your Lekt AI account. If you are unable to exercise your rights through your account, please submit your request to hello@lekt.ai.
5.4. Please note these rights may be limited, for example if fulfilling your request would reveal Personal Data about another person, or if you ask us to delete information that we are required by law or have compelling legitimate interests to keep.

6. Children

Our Services are not directed to, or intended for, children under 13. We do not knowingly collect Personal Data from children under 13. If you have reason to believe that a child under 13 has provided Personal Data to Lekt AI through the Services, please email us at hello@lekt.ai. We will investigate any notification and, if appropriate, delete the Personal Data from our systems. Users under 18 must have permission from their parent or guardian to use our Services.
